1. Agreement to Terms

By accessing or using the One Life Medicine website (onelifemedicine.com), patient portal, or any of our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

These Terms apply to all visitors, patients, and users of our website and platform. Additional terms may apply to specific services, such as the Membership Agreement governing your patient membership.

2. About Our Practice

One Life Medicine is a concierge, membership-based functional medicine practice. Clinical services are provided by Dr. Jennifer Park, MD, a licensed physician in the State of California. Business operations and the technology platform are managed under a separate Management Services Organization (MSO).

Our services are not a substitute for emergency medical care. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately.

3. Eligibility

You must be at least 18 years of age to use our services and create a patient portal account. By using our services, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. Patient Portal Account

4.1 Account Creation

When you enroll as a member, you will create a patient portal account with a unique email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

4.2 Account Security

You agree to notify us immediately at thrive@onelifemedicine.com if you become aware of any unauthorized use of your account. We implement security measures including encrypted authentication, automatic session timeout after 30 minutes of inactivity, and audit logging of all access to health records.

4.3 Account Accuracy

You agree to provide accurate, current, and complete information when creating your account and completing intake forms. Inaccurate health information may adversely affect the quality of care you receive.

5. Membership and Billing

5.1 Membership Model

Our practice operates on a subscription membership model. Membership tiers, pricing, included services, and commitment terms are described on our Membership page and in the separate Membership Agreement you sign at enrollment.

5.2 Payment Processing

All payments are processed through Stripe, Inc., our third-party payment processor. By enrolling, you authorize Stripe to charge your payment method on a recurring basis according to your selected billing cycle (monthly or annual).

5.3 Cancellation

Membership cancellation terms are governed by your Membership Agreement. Cancellation does not entitle you to a refund of fees already paid except as specified in the Membership Agreement.

6. Permitted Use

You may use our website and patient portal for the following purposes:

  • Accessing information about our practice and services
  • Enrolling in a membership
  • Completing intake forms and health questionnaires
  • Viewing your health records, lab results, and treatment plans
  • Communicating with your care team through secure messaging
  • Managing your appointments and account settings

7. Prohibited Use

You agree not to:

  • Use our platform for any unlawful purpose
  • Attempt to gain unauthorized access to other users' accounts or data
  • Interfere with or disrupt the platform's functionality or security
  • Use automated tools, bots, or scrapers to access our platform
  • Upload malicious files, viruses, or harmful code
  • Impersonate another person or misrepresent your identity
  • Share your login credentials with any other person
  • Use the platform to transmit spam, solicitations, or unauthorized communications
  • Reproduce, distribute, or create derivative works from our website content without permission

8. Health Information and Medical Disclaimer

8.1 Not Emergency Care

Our platform and services are designed for functional medicine consultations, ongoing care management, and patient communication. They are not intended for emergency medical situations. Always call 911 for medical emergencies.

8.2 Website Content

The information provided on our website, including blog posts and educational content, is for general informational purposes only and does not constitute medical advice. It should not be used as a substitute for professional medical evaluation, diagnosis, or treatment.

8.3 Clinical Decisions

All clinical decisions, diagnoses, treatment plans, and medical advice are made by Dr. Jennifer Park, MD, within the context of an established patient-physician relationship. The technology platform facilitates but does not replace the clinical judgment of your physician.

8.4 Lab Results

Lab results displayed in the patient portal are provided for your reference and should be interpreted in consultation with Dr. Park. Do not make changes to your medications, supplements, or treatment plan based solely on lab results without consulting your physician.

9. Secure Messaging

Our patient portal includes a secure messaging feature for communication between you and your care team. Secure messaging is intended for non-urgent clinical questions, appointment-related communication, and general health inquiries.

Secure messaging is not for emergencies or urgent medical needs. Messages may not be reviewed immediately. If you need urgent medical attention, call the practice directly or visit an emergency room.

Messages are encrypted, stored securely, and subject to HIPAA protections. All message access is audit-logged.

10. Intellectual Property

All content on our website, including text, graphics, logos, images, blog posts, and software, is the property of One Life Medicine or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

The One Life Medicine name, logo, and related marks are trademarks of One Life Medicine. You may not use these marks without our prior written consent.

11. Third-Party Links

Our website may contain links to third-party websites or services that are not owned or controlled by One Life Medicine. We have no control over and assume no responsibility for the content, privacy policies, or practices of third-party sites. Your use of third-party sites is at your own risk.

12. Limitation of Liability

To the maximum extent permitted by applicable law, One Life Medicine, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or platform, including but not limited to loss of data, loss of profits, or interruption of service.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to One Life Medicine in the 12 months preceding the event giving rise to the claim.

This limitation of liability does not apply to claims arising from medical malpractice, which are governed by California medical malpractice law.

13. Indemnification

You agree to indemnify, defend, and hold harmless One Life Medicine and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the platform, or your violation of any third party's rights.

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

14.2 Arbitration

Any dispute arising from or relating to these Terms or your use of our services (excluding claims for medical malpractice) shall be resolved through binding arbitration in Los Angeles County, California, in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in a class action.

14.3 Exceptions

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights or other irreparable harm.

15. Modifications

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website with a revised "Last Updated" date. Your continued use of our services after such changes constitutes your acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, HIPAA Notice of Privacy Practices, and Membership Agreement, constitute the entire agreement between you and One Life Medicine regarding your use of our services.
